Plain English Summary: Use SpectraSort to sort your photos. Don't use it for anything illegal. We're not responsible if something goes wrong with your photos (but we've designed the app to be safe). You own your photos and your Sort Style Profile. We can update these terms, and we'll let you know if we do.
1. Acceptance of Terms
By downloading, installing, or using SpectraSort ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree, please don't use the App.
2. Description of Service
SpectraSort is a photo organization application that uses on-device artificial intelligence to help users sort and curate their photo libraries. The App includes features for:
- Analyzing photo quality and aesthetics
- Learning user preferences over time
- Sorting photos based on learned preferences
- Creating and sharing Sort Style Profiles
3. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not attempt to reverse engineer, decompile, or extract source code from the App
- Not use the App to infringe on others' intellectual property rights
- Maintain appropriate backups of your photos (the App is not a backup service)
4. Photo Library Access
The App requires access to your device's photo library to function. By granting access, you acknowledge that:
- All photo processing occurs locally on your device
- The App may read photo data to perform analysis
- The App will not modify or delete photos without your explicit confirmation
- You can revoke access at any time through your device settings
5. Intellectual Property
Your Content: You retain all rights to your photos and any Sort Style Profiles you create. We claim no ownership over your content.
Our Content: The App, including its code, design, AI models, and documentation, is owned by SpectraSort and protected by intellectual property laws. You receive a limited, non-exclusive license to use the App for personal purposes.
6. Sort Style Profile Sharing
When you share your Sort Style Profile:
- You grant recipients permission to use your preference data to sort their own photos
- You are responsible for choosing with whom you share your Sort Style Profile
- Shared Sort Style Profiles cannot be "recalled" once shared
- Your Sort Style Profile contains only preference parameters, not photos or personal data
7. In-App Purchases and Subscriptions
SpectraSort operates on a "sorting is free, actions require premium" model:
- Free features: Photo sorting with AI Sort and My Sort modes, learning your preferences, building your Sort Style Profile
- Premium features: Saving photos to albums, sharing photos, deleting photos from your library
New users receive a 7-day free trial of premium features. After the trial expires, premium access requires an in-app purchase or subscription. These are processed through Apple's App Store and are subject to Apple's terms. Refunds are handled according to Apple's refund policies.
8. Disclaimer of Warranties
The App is provided "as is" without warranties of any kind. We do not guarantee that:
- The App will meet all your requirements
- The App will be error-free or uninterrupted
- AI analysis results will be perfectly accurate
- The App will be compatible with future iOS versions
9. Limitation of Liability
To the maximum extent permitted by law, SpectraSort shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of photos or data
- Loss of profits or business opportunities
- Damage to your device
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Photo Deletion
When you choose to delete photos through the App:
- Photos are moved to iOS's "Recently Deleted" folder
- Photos remain recoverable for 30 days (per iOS behavior)
- We strongly recommend reviewing photos before confirming deletion
- SpectraSort is not responsible for photos you choose to delete
11. Updates and Changes
We may update the App and these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App or via the App Store.
12. Termination
You may stop using the App at any time by deleting it from your device. We reserve the right to terminate or suspend access to the App for violations of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, USA. Any disputes shall be resolved in the courts of California, USA.
